The Work You Will Do:

The equal opportunity officer is responsible for the development and coordination of the Department’s equal opportunity and affirmative action programs and for the development and implementation of the Department’s civil rights compliance monitoring and technical assistance programs. These responsibilities entail coordination with department units as well as the regional workforce boards to ensure compliance with the nondiscrimination regulations applicable to recipients of federal financial assistance. This responsibility extends to all areas: application for employment; application for programs and services; and program participation and service delivery. Some out-of-town travel may be necessary.

The equal opportunity officer is also responsible for ensuring that appropriate training opportunities are available to Department staff, at all grade levels and in all occupational areas, on a nondiscriminatory basis and that civil rights program-related training is an integral part of the Department and other recipient programs.

The Department’s Office of General Counsel works closely with the Department’s divisions and various program areas to provide legal assistance and advice that is responsive to the specific needs of the Department, division, or program area. The Office of General Counsel serves the entire Department in many different capacities including rendering legal advice and opinions to Department staff in the areas of Economic Development, Community Development, Workforce Services, Human Resources, Reemployment Assistance, and Finance and Administration.

PAY: $80,000 – $90,000 Annually

Your Specific Responsibilities:

  • Oversee the development and implementation of the state’s Methods of Administration under 29CFR part 37. Manage the civil rights compliance program for the Department, coordinate and participate in all phases of the review of programs receiving federal financial assistance from or through the Department. Perform desk reviews of service-delivery data and locally developed policies to ensure compliance with applicable regulations; conduct site reviews; prepare reports of review; review corrective-action plans and develop and review conciliation agreements.
  • Develop and deliver or arrange for civil rights program training for Department and other recipient management and staff. Provide technical assistance as necessary.
  • Develop and coordinate implementation of guidelines for filing complaints of discrimination and the procedures for alternative dispute resolution. Conduct or coordinate investigation of discrimination complaints; prepare and review reports of investigation; arrange for and review and monitor the results of mediation of discrimination complaints. Develop, coordinate, and monitor implementation of the Department’s affirmative-action plan.
  • Prepare and disseminate routine and special reports required under applicable federal and state regulations; prepare activities reports and trends analyses. Serve as the Department’s principal liaison with federal, state, and local agencies and organizations regarding civil rights program related issues. Serve as the Department’s principal contact person on program and facility-accessibility issues under federal and state accessibility guidelines. Review proposed civil rights program-related legislation and regulations.
  • Perform other legal duties as assigned by the General Counsel.
  • Anything outside of day-to-day functions that is directly related to Federal regulations will have the oversight of the Secretary of FloridaCommerce.

Required Knowledge, Skills, and Abilities:

  • Written and oral communication, including plain-language writing.
  • Ability to investigate complaints and write the reports of investigation.
  • Ability to provide oral and written analysis of statistical data and written materials.
  • Initiative, critical thinking, judgment, thoroughness, time-management, and attention to detail.
  • Ability to engender confidence from agency leadership.
  • Working knowledge of Chapter 120 administrative proceedings.
  • Experience providing legal advice on various issues and matters.
  • Working knowledge/experience using Microsoft Office applications, including Word, Excel, and Outlook.

Qualifications:

As a condition of pre-employment eligibility, a Level 2 security background screening is required, which consists of fingerprinting and a check of local, state, and national law enforcement records.

Minimum:

  • Juris Doctor from a law school accredited by the American Bar Association.
  • At least one (1) year of experience practicing law.
  • Must be an active member of The Florida Bar in good standing and eligible to practice law.
